Some commenters have questioned the use of the term "not-certified." The final rule makes use of this language to avoid any impression that a CDL holder is not medically qualified. This also makes it clear that the driver is not being denied the right to drive because of any adverse action taken by FMCSA. The final rule also requires the State-designated licensing authority (SDLA) to publish the medical certification status on a CDL holder's CDLIS driver record. This will help prevent false and misleading claims that drivers are medically qualified when, in reality,

To further deter fraud and fraud, the SDLA must include the contact details of the ME who performed a medical exam in the driver's file. This requirement will remain in place until FMCSA releases new rules to deal with this issue. In the meantime, motor companies can keep the original or a copy the medical examiner's certification in their driver qualification records as evidence that the driver is medically qualified in the event that the carrier can prove the date of receipt of the certificate from the ME.
